During the hearing of the case on Monday, the Delhi High Court made a big comment in its order regarding students not yet getting textbooks and uniforms in MCD schools.
1. Both Delhi Government and Delhi Municipal Corporation have failed in providing basic facilities to the students studying in MCD schools. This is a violation of the constitutional right of students to get education.
2. The decision to leave the post of Chief Minister despite the arrest is a personal decision of Arvind Kejriwal.
3. The court said that children’s education should not be hindered due to unavailability or non-formation of a standing committee in the Municipal Corporation.
4. Due to national interest and public interest, no person holding a constitutional post can remain out of reach of the public for a long time.
5. It is clear from the statement given by Minister Saurabh Bhardwaj in the court that in the absence of Chief Minister Arvind Kejriwal, the work of the government has come to a standstill.
6. Kejriwal’s decision to remain on the post of CM despite being arrested does not mean that the future of the students should be played with. They should be kept away from their fundamental rights.
