New Delhi. The Supreme Court will hear on Monday a public interest litigation (PIL) against the three new criminal laws that have replaced the IPC, CrPC and the Evidence Act. According to the list published on the apex court website, the vacation bench of Justice Bela M Trivedi and Justice Pankaj Mithal will hear the case on May 20.
The petition says that there are many discrepancies in the Indian Justice Code, the Indian Evidence Act and the Indian Civil Defense Code. The petition filed by lawyer Vishal Tiwari said, “All three criminal laws were passed without any parliamentary debate. Most of the members in Parliament were suspended at that time.”
Furthermore, the petitioner says that the titles of the three laws do not fit the interpretation of the law and do not explain the law and its purpose. In a recent decision, the Supreme Court had asked the legislature to consider making necessary changes in the provisions of the Indian Judicial Code 2023, which provides for punishing the husband and his family for any kind of cruelty to a married woman.
The new penal code is to come into effect from July 1. It has been said that Sections 85 and 86 of the new law are nothing but a complete copy of Section 498A of the IPC. This needs to be reconsidered by the legislature.
