Chennai. The Madurai Bench of the Madras High Court ordered the removal of a public prosecutor in the Periyakulam district munsif court in Theni district due to pending criminal case against him. Raju had filed a complaint in the court that a criminal case against his mother and wife along with public prosecutor SPM Arif Rehman was still pending in the Theni district court.
Arif, who was appointed as the public prosecutor after the DMK government came to power in October 2021, suppressed the facts of the criminal case against him and took police approval for posting.
Following a complaint by advocate Raju, Justice Subramaniam of the Madurai bench of the Madras High Court ordered the district magistrate of Theni to investigate the pending criminal case against the public prosecutor. The District Magistrate, after investigation, said that the case against Arif was neither settled nor he had taken bail.
The report also said that the local police inquired about the case in an impartial manner and omitted his name from the chargesheet without due legal process or valid reasons.
Justice Subramaniam, after going through the report, observed that the police in connivance with the public prosecutor and tried to cover up the misdeeds of the petitioner. The court also said that even for small jobs in the state government, the police investigate the antecedents and actions of a person, but in this case it is clear that no such inquiry was conducted.
