The Bombay High Court on Friday closed all arguments on the habeas corpus petition filed by Nawab Malik, a minister in the Maharashtra government. Malik, a senior leader of the Nationalist Congress Party (NCP), had filed this petition on behalf of the Enforcement Directorate (ED) challenging his arrest. The High Court will pronounce its verdict on this petition on March 15.
Nawab Malik, the Minority Development Minister in the Maharashtra government and the chief spokesperson of the NCP, was arrested by the ED on February 23. He was arrested in a money laundering case involving the activities of fugitive gangster Dawood Ibrahim and his associates. He was first sent to ED custody and later to judicial custody.
A bench of Justices PB Varale and SM Modak reserved its order after three days of extensive arguments by both the sides. The bench said that the award will be pronounced on March 15. Nawab Malik’s advocate Amit Desai had earlier told the High Court that his arrest and remand was illegal and he should be released immediately.
ED opposes Malik’s plea
Additional Solicitor General Anil Singh and advocate Hiten Venegaokar, appearing for the ED, told the court that Malik’s arrest was made after following due process. A special PMLA court had issued the remand order. He also gave valid reasons for sending the court to ED custody and then to judicial custody.
