The Supreme Court has recently given an important verdict. The apex court said that if a woman has been in a live-in relationship for a long time, then the man cannot be accused of having sex with a false marriage. The Supreme Court also said that in such cases it is difficult to decide whether the reason behind sex was just the promise of marriage. The case was between a bank manager and his 16 -year -old partner who was a lecturer. The woman had alleged that the person made a physical relationship with her by making a false promise of marriage, due to which she had filed a case of rape.
“Both sides were educated.”
A bench of the Supreme Court of Justice Vikram Nath and Justice Sandeep Mehta dismissed the criminal proceedings filed against the person in the case. The court admitted that both sides were educated and their relationship was consent.
The court said that the relationship has deteriorated
The court also said that both used to meet each other despite being posted in different cities. The Supreme Court described the case as a matter of live-in relationship.
What did the court say in its judgment?
The court said in its judgment, “It is difficult to believe that the complainant accepted the pressure of the accused to have sex for almost 16 years without any objection, alleging that he was forced to have sex by falsely promising marriage.”
“There was no cheating between the two sides”
The court also admitted that the long term of the relationship proves that there was no deception between the two sides. Constant sexual relations between the two for a long period of 16 years show that there was never any rape or cheating in the relationship.
“When a woman stays in a relationship for 16 years, …”
The Supreme Court also said that when a woman has been in a relationship for 16 years, her allegation that physical relationship was only based on the promise of marriage is not reliable. Even though the false promise of marriage has been made, but the woman’s long -term remaining in that relationship weakens her charge.
