Lucknow. Special Judge of POCSO Court Arvind Mishra has sentenced a man named Mohammad Asif Khan, who was found guilty of raping and murdering his five-year-old niece eight years ago. While pronouncing the verdict, the judge said that the guilty should be hanged.
The court, however, referred the matter to the High Court for confirmation of death sentence, which is a statutory requirement before execution of sentence.
In his 83-page judgement, the judge said the manner in which the offense was committed, the case came under the category of rarest of rare.
The case was based on circumstantial evidence and the prosecution was able to prove its case beyond doubt.
The incident was reported to the Hasanganj police on 4 April 2014 by the maternal grandfather of the victim girl.
It was alleged in the FIR that the girl was missing and the information was given to the police on number 100.
From the evidence of witnesses, the court found that the girl was last seen having ice cream with the accused Khan.
On the night of the incident, the accused came in front of the family with the body of the girl in hand.
At that time his hands were tied and the nerves of both the hands were cut. During interrogation the accused confessed his crime in front of the police.
Later, a blood-stained knife and slippers were recovered in this case.
