Mihir Shah, prime accused in the Mumbai BMW hit-and-run case and son of Shiv Sena leader Rajesh Shah, has approached the Bombay High Court seeking his immediate release, claiming that he was being held illegally. Mihir was arrested on July 9, two days after his BMW car hit a scooter-riding couple in Mumbai’s Worli area. In the incident, a woman named Kaveri Nakhwa (45) was killed and her husband Pradeep was injured.
In his habeas corpus petition filed in the high court last week, Shah claimed that his detention was illegal and he should be released immediately. A division bench of Justices Bharati Dangre and Manjusha Deshpande is likely to hear the petition on Wednesday. In his petition, Shah requested the quashing of the order passed by the local court in which he was first sent to police custody and then to judicial custody.
Under this section, the police, while arresting a person, has to give him full details of the crime for which he is being arrested or other grounds for such arrest. Shah has requested to declare his arrest illegal. Shah (24) is accused of fleeing towards Bandra Worli Sea Link after the accident, while the woman remained on the bonnet of the car and then kept getting dragged under the wheels of the car for more than 1.5 km.
According to the police, Shah, who fled from the scene, was drunk at that time. Shah’s father Rajesh Shah and his driver Rajarshi Bidawat were also arrested in the case. Rajesh Shah is a former leader of the Eknath Shinde-led Shiv Sena. Rajesh Shah got bail, while Mihir Shah and Bidawat are currently in judicial custody.
