New Delhi, Chief Justice of the Supreme Court (CJI) D.Y. Chandrachud has said a big thing about the pressure of governments on judges. He said, it has been 24 years since I have been working as a judge, but no government has ever put any kind of pressure on me. I have never had to face political pressure. Chandrachud said, I think that judges in India should take decisions according to established traditions based on constitutional system rather than emotions in cases. They are also given training for this.
The CJI was answering a question at a function organized by the Oxford Union. Dr. Chandrachud said, “If you ask me about political pressure, government pressure, then I want to tell you that I have been a judge for 24 years, and I have never faced political pressure from the ruling party. The democratic traditions we follow in India also include that we live a life isolated from the political organ of the government.” Talking about ‘social pressure’, he said that judges often think about the social impact of their decisions.
Many of our decisions have a profound impact on society
Dr. Chandrachud said, ‘Many of our decisions have a profound impact on society. As judges, I believe it is our duty to be aware of the impact of our decisions on the social order.’ CJI Chandrachud has been advising judges on this earlier as well. He has been motivating them to make decisions openly and to understand and listen to the public.
Should not work like a tape recorder
A few days ago, the CJI had said that judges should not act as mere tape recorders. Courts have to play the role of a facilitator during the hearing. Therefore, while recording the statements of witnesses in any kind of case, one should not remain just a tape recorder. The court should exercise effective control over the proceedings so that the truth can be reached. Reaching the truth and providing justice is the first duty of the court.
