New Delhi. After the divorce between former Pakistani cricket team captain Shoaib Malik and Indian tennis star Sania Mirza for a long time, Shoaib has married for the third time. But many people will obviously have this question in their mind that when Sania and Shoaib lived happily with each other for almost 23 years, then how did the distance between them suddenly increase, did Shoaib divorce Sania Mirza? Now Sania Mirza’s father Imran Mirza has given clarification on this. While making the world aware of the reality regarding the divorce between the two, he said that this divorce was given by Sania, which is called ‘khula’ in Islam.
What is ‘open’?
In Islamic law, “khula” is a process through which a Muslim woman can ask for a divorce from her husband. Unlike divorce given by the husband, Khula is initiated by the wife. The word “khula” itself means “to open” or “to loosen the knot”. To get open, a woman usually has to request a divorce from a religious leader. This process may involve the wife giving the husband something of value (such as returning dowry) in exchange for his consent to divorce. If the husband agrees, divorce takes place.
How does ‘khula’ mean in Islamic law?
Islamic jurisprudence accepts the woman’s right to seek khula in specific circumstances, such as when the marriage has become unstable, and the wife believes that continuing the relationship is detrimental to her well-being. However, the specific rules and procedures for khula may vary depending on the interpretation of Islamic law adopted by different schools of thought within Islam.
