The court in its decision has asked the husband to pay alimony to his divorced wife even after the period of iddat. Let us tell you that the Iddat period in Islam is of 40 days. After which the divorced woman can marry any other man, but now the court has made it clear in its decision that the man will have to pay alimony to his divorced wife for life and this alimony should be such that before the divorce the women used to live their lives. The court said in its decision that under Section 3(2) of the Muslim Women (Protection of Rights on Divorce) Act 1986, a divorced woman can file an application before the magistrate for alimony from her ex-husband. Keep in mind that this decision has been given by the division bench of Justice SP Kesarwani and Justice MAH Idrisi. The court has asked the magistrate to give orders related to alimony and dowry in three months. The court has made it clear that till the rates of alimony are not fixed by the magistrate, till then the husband will have to pay alimony of five thousand rupees per month. Thereafter, after passing the respectable prescribed rates, the husband has to pay alimony to his divorced wife. Allahabad High Court has given this decision on the petition of Shoural Nurul Haq. Please tell that Nurul Haq Khan and Khatoon were married on 21 May 1989. But on 28 June 2002, Nurul Haq divorced Khatoon. Zahid filed an application under Section 3 of the Muslim Women Protection Act on September 10, 2002, before the Additional Chief Judicial Magistrate, Junior Division, Ghazipur.
