Protests started outside Delhi Chief Minister Arvind Kejriwal’s residence on Thursday night after the Enforcement Directorate (ED) arrested him in a money laundering case related to the Delhi liquor scam. Delhi Police has detained about two dozen Aam Aadmi Party (AAP) MLAs, including its MLAs, who were trying to block the road near the Chief Minister’s residence. While the Enforcement Directorate (ED) team was interrogating Kejriwal at his residence, party leaders and workers started gathering in the area.
Now that Arvind Kejriwal has been arrested, the options for legal relief available to Kejriwal have changed. Now the petition to stay the arrest has ended. Now Kejriwal will have to challenge the arrest. After Kejriwal’s arrest, it is unlikely that he will get relief directly from the Supreme Court.
What is the ground of Arvind Kejriwal’s arrest in Delhi liquor scam? ED had made these allegations
first legal option
His first option for legal relief will be to apply for bail. For bail he will first have to approach the lower court.
The second option
The second option would be to challenge the arrest in Delhi High Court/Supreme Court by raising questions on the process of arrest.
Sanjay Singh had tried this option
Sanjay Singh has tried these options before. Sanjay Singh’s bail application is pending in the Supreme Court after being rejected by the lower court and Delhi High Court. Sanjay Singh’s second petition challenging the arrest is also pending in the Supreme Court after being rejected by the High Court.
According to the Supreme Court’s decision given recently regarding PMLA, ED has to tell the accused in writing what is the basis of arrest? That process is still going on.
