Bhiwadi. The Rajasthan Real Estate Regulatory Authority (RERA) has ordered the buyer Gurpreet Kaur to return the entire money with interest, giving a major setback to Crystal Buildtech Private Limited. RERA has severely accused the builder of fraud and violation of rules.
According to the case, Gurpreet Kaur booked a flat in the “Krrish Nikunj” project and paid a full payment of Rs 7,27,200 between February 2021 to July 2023. But the builder neither created the agreement to sale nor gave him possession. Gurpreet Kaur lodged a complaint with RERA.
The builder argued that Gurpreet Kaur voluntarily changed the unit and the possession of the new unit was fixed on 11 July 2022. The builder also said that he had offered possession only on 11 April 2022.
RERA Chairman Veenu Gupta dismissed the builder’s arguments and said that the project was lapsed on 1 April 2022. The Completion Certificate given by the builder was not uploaded on the RERA portal. RERA also said that when the Completion Certificate was valid in 2020, why was the possession given in 2022 and why the extension was sought. RERA also accused the builder of violating the rules.
RERA said that the builder took full money without creating the agreement to sale, which is a violation of Section 13 of the RERA Act. RERA has ordered the builder to return the entire money of Gurpreet Kaur with Rs 7,27,200 11.10% interest. Interest will be paid from 11 July 2022 till the date of payment. This decision of RERA is a strict message for the builders not to cheat buyers and follow the rules.
