New Delhi. A woman had filed an FIR against BJP leader Syed Shahnawaz Hussain accusing him of rape. The woman had alleged that the BJP leader misbehaved with her at a farmhouse in Delhi. Now the Delhi High Court has given a big relief to Hussain in this case. Delhi Police had presented a report related to the cancellation of the FIR in the court, which was accepted by the High Court. Earlier, the District Court of Delhi had also given relief to the BJP leader on the basis of this report.
Justice Neena Bansal Krishna said there was no error in the order passed by the Additional Sessions Judge (ASJ) and dismissed the woman’s plea for reinvestigation challenging the December 2023 order. The High Court said, “In the present case, the documentary and scientific evidence collected during the investigation completely refutes the presence of respondent number two (Hussain) and the complainant at the alleged scene of incident on the date of the alleged incident. In such a situation, the possibility of the alleged crime having occurred becomes zero.

In an order passed on Friday, the high court said, “Therefore, the conclusion of the judge in accepting the report of quashing the FIR is upheld. In view of these discussions, there is no error in the order dated December 16, 2023 and the revision petition is dismissed.” The complainant had alleged that Hussain gave her intoxicants and raped her at a farmhouse in the national capital in April 2018.

FIR was lodged by the Magistrate Court…
The police had filed a report in the court requesting to quash the FIR. The report to quash the FIR was not approved by the magistrate court, which had taken cognizance of the alleged offence and summoned Hussain in the case. This order was challenged in the sessions court, which set aside the order of the magistrate court and accepted the report on December 16, 2023. Aggrieved by the order, the complainant approached the High Court and filed a revision petition.

The High Court said in its order that the judge had referred to the entire detailed investigation conducted by the investigating officer. In January 2023, the Supreme Court had dismissed Hussain’s petition challenging the Delhi High Court’s order to register an FIR and start an investigation. The apex court had refused to interfere with the High Court order and said that Hussain can resort to any remedy available under the law.
There was no relief from the High Court and Supreme Court.
On August 17, 2022, the High Court had dismissed Hussain’s plea challenging a trial court order directing the Delhi Police to register an FIR against him, saying there was no error in the 2018 order. In 2018, a Delhi woman had moved the trial court seeking registration of an FIR against Hussain for alleged rape. However, the BJP leader had denied the allegation.
