New Delhi. The Supreme Court has refused to lift the ban on the survey in the Sri Krishna Janmabhoomi and Shahi Idgah dispute case in Mathura for now. The apex court has extended the ban on the survey till November. The court said in its order today that the matter needs a long hearing, so the survey cannot be allowed right now. A bench of Justice Sanjeev Khanna and Justice Sanjay Kumar is hearing three special leave petitions.
Two of these petitions were filed by the Shahi Idgah Mosque Committee and the Uttar Pradesh Sunni Central Waqf Board, challenging the May, 2023 order of the Allahabad High Court, under which it transferred a batch of pending cases on the dispute in the Mathura court to itself. At the same time, the third petition was filed by the Masjid Committee, challenging the order passed by the Allahabad High Court in December, 2023. In this order, the appointment of a court commissioner to inspect the Shahi Idgah Mosque was allowed.
Vishnu Shankar Jain, the advocate of the Hindu side, urged that the matter has become meaningless as the Allahabad High Court has recently dismissed the petitions filed by the Masjid Committee under Order 7 Rule 11 CPC. However, the Supreme Court adjourned the matter till November and said that the order of the Allahabad High Court will have to be considered. Let us tell you that on a date of this month, the Allahabad High Court rejected the objections of the Muslim side and said that all the cases filed by the Hindu side are worth hearing. A single bench of Justice Mayank Kumar Jain of the High Court, while giving the verdict, has fixed August 12 as the date for hearing the petitions of the Hindu side.
