On February 14, special judge DE Kothalikar, who was appointed to hear the NIA cases, rejected the bail plea of Haney Babu. The detailed order in this regard became available on Monday. The special court in its judgment referred to a letter in which the NIA has alleged that there was an exchange between co-accused Rona Milson and a person named Prakash.
The court observed that prima facie it appears from the contents of the letter that the CPI (Maoist) was intent on dismantling the ‘Modi Raj’, that is, the government led by Prime Minister Narendra Modi. Not only this, he was considering to carry out another incident like the death of former Prime Minister Rajiv Gandhi by targeting Prime Minister Modi’s roadshow.
Babu’s number was in the pamphlets distributed for the release of CPI member
Special Judge Kothalikar said that if the allegations are considered in proper perspective, there will be no hesitation in concluding prima facie that the accused have acted to endanger the unity, integrity, security and sovereignty of India. The court observed that it is pertinent to note that the mobile number of Babu was in the pamphlets distributed for the release of GN Saibaba, a member of the banned organisation.
As per the order, it is sufficient to show prima facie that there was involvement of the applicant in furthering the activities of CPI (Maoist).
