The Supreme Court on Friday stayed the decision of the Allahabad High Court.The High Court had allowed a court-supervised survey of the Shahi Idgah Mosque.Justice Sanjiv Khanna’s bench gave an important decision in the Supreme Court today.
New Delhi. The Supreme Court on Friday extended the stay on the Allahabad High Court’s decision allowing a court-monitored survey of the Shahi Idgah Mosque complex adjoining the Krishna Janmabhoomi temple in Mathura. A bench of Justices Sanjiv Khanna and Sanjay Kumar ordered the continuation of the stay imposed by the Supreme Court on January 16 on the implementation of the High Court’s December 14, 2023 order.
The High Court had allowed a court-monitored survey of the Shahi Idgah Mosque complex and agreed to appoint a court commissioner to monitor it. The Hindu side claims that there are signs present in the complex which show that there was once a temple there. During the hearing, advocate Vishnu Shankar Jain, appearing on behalf of the Hindu parties, said that the appeal of the Shahi Masjid Idgah Management Trust Committee against the High Court’s order of December 14 last year and related orders in the case has failed.

He said, “All these petitions have become infructuous because the High Court has given its order on August 1.” Jain cited the High Court’s August 1 order, in which it had dismissed the plea of Muslim parties challenging the maintainability of 18 cases related to the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura and ruled that the religious character of the mosque needed to be determined.
