New Delhi. Tis Hazari Court has rejected the anticipatory bail plea of Vibhav Kumar, arrested on charges of assaulting former Delhi Women Commission chairperson and Aam Aadmi Party Rajya Sabha MP Swati Maliwal. The court said that the accused has already been arrested by the police, hence there is no justification for hearing it. Delhi Police has arrested Chief Minister Arvind Kejriwal’s PM Vibhav Kumar from CM House today itself. A case has been registered against Vibhav Kumar under sections 308, 354B, 506 and 509 of IPC. Section 308 of IPC is registered for culpable homicide. According to this, if anyone suddenly attacks someone in a situation in which the other person may die, then action is taken under Section 308. An accused under Section 308 may have to face imprisonment of up to seven years and pay a fine. The second section is 354B of IPC, this section is imposed on an accused when someone disrobes a woman by using force, that is, if the woman’s clothes are torn. There is a provision for imprisonment of three to seven years for the accused.
The third section which is imposed on Vibhav is Section 506 of the IPC, under this, it applies to any person who, for any reason, threatens to cause harm to the life, property or family of another person. In this, the accused can be sentenced to two years in jail or fine along with punishment. Under Section 509, if any person uses abusive words or makes obscene gestures towards a woman or tries to outrage the modesty of a woman, action is taken under it. In this, the accused can be punished with imprisonment for a maximum of three years or fine along with fine.
