The Allahabad High Court has said that the Poxo Act created to protect minors from sexual exploitation has now become the weapon of their exploitation. Giving bail to the accused in one case, Judge Krishna Pahal said, “The purpose of this law is not to declare the love affair between the teenagers a crime.”
If the victim’s statement is ignored and the accused is left to serve sentence in jail, it will be a failure of justice. The court has provided conditional bail to the accused with the above comment. A case has been registered against the 18 -year -old accused at Chakia police station in Chandauli under sections 137 (2), 87, 65 (1) of the Indian Penal Code and Section 3/4 (2) of the Poxo Act on charges of raping a 16 -year -old girl. The arrest was made on 7 March 2025. It was argued that the case was consensual sexual intercourse and there was no medical confirmation of the incident. There is no reason for a 15 -day delay in registering an FIR. The applicant has no criminal history.
