The Delhi High Court has warned that if every sadhu, guru and other religious figure is allowed to build a place of worship on public land, it will have dire consequences and wider public interest will be endangered. While hearing a petition, Justice Dharmesh Sharma said, “There are thousands of sadhus, babas, faqirs, gurus at various places in our country and if everyone is allowed to build a place of worship or a samadhi on public land and vested interest groups are allowed to continue using it for private gain, it will have disastrous consequences and wider public interest will be endangered.”
Naga Sadhu had filed the petition
The petition was filed by Mahant Naga Baba Bhola Giri through his heir. It urged the court to order the District Magistrate to provide land at Nigam Bodh Ghat. The petitioner claimed ownership of the land before the 2006 deadline set by the Delhi Special Laws Act. The court found that the petition lacked substance and the District Magistrate had already rejected the request. He had declined the request citing urbanisation of the land and non-availability of relevant revenue records.
What did the High Court say?
Justice Sharma said that the petitioner’s occupation of the land was undoubtedly illegal because “the fact that he had cultivated a piece of land for 30 years or more does not give him legal right, ownership or reason to continue to occupy that land”. The court also underlined that there was no history of people having faith or performing worship there. The court also rejected the argument of pending investigation by the Religious Affairs Committee on the demolition of the structure at that site. The court said that it was a private place and there was no question of common people having faith there.
Commenting on the expectations from Naga Sadhus, Justice Sharma said, “Naga Sadhus are devotees of Lord Shiva. They have to lead a life free from worldly attachments. Therefore, seeking ownership of property in their name is against their belief and practice.” (With IANS inputs)
