The atmosphere in the country is tense when students are suffering due to cheating, irregularities and paper leaks in NEET and NET exams. At the same time, two strict laws have been passed to prevent cheating in exams and those who make others cheat. One law was notified by the Center on June 21 and the other was made in the form of an ordinance in UP five days later. The law of UP is so strict that it will make you rot in jail for life. After all, what is the difference between the laws of the Center and UP and on which exams will these be applicable.
The UP Cabinet approved the Uttar Pradesh Public Examination (Prevention of Unfair Means) Ordinance 2024 to curb paper leaks in competitive and other examinations. This law was made quickly and implemented as an ordinance. UP is also counted among those states where many cases of paper leak and cheating have taken place in the last few years.
On which exams will UP’s law be applicable
– Public Service Commission, Uttar Pradesh Subordinate Service Selection Board, UP Board, University, Authority or Body. All exams, degree-diploma, certificates or educational certificates of the institutions of the state along with the exams of the designated institutions.
What else will come under the purview of cheating in exams
– Paper leaks of various exams, organised copying of papers, paper solver gangs, distribution of fake question papers, creation of fake employment websites are now punishable offences
– Institutions and service providers found to be involved in exam malpractices will be permanently blacklisted
what is the provision of punishment
– If the exam is affected, the loss will be recovered from the solver gang
– Institutions and service providers found to be involved in exam irregularities will be blacklisted permanently. Their property will also be confiscated.
– 10 years to life imprisonment and fine up to Rs 1 crore for leaking the paper. In some cases, the sentence can be up to two years in jail.
What is the Central Exam Cheating Law?
The name of the central law is The Public Examinations (Prevention of Unfair Means) Bill, 2024, it has been notified from June 21. In this, strict provisions have been made for organized copying and paper solving by paper leak for exam cheaters. It includes all the central recruitment exams from the central board examinations. It includes all those things which affect the exams and papers.
Which exams will the central law cover?
This law covers major central government examinations like UPSC, SSC, Railway Recruitment, Banking exams and all NTA computer-based examinations like JEE, NEET, CUET.
what will come under its purview
This law will include “leaking of question paper or answer key”, “assisting any candidate in a public examination in any unauthorized manner, directly or indirectly”, and “tampering with computer network or computer resource or computer system” as crimes committed by any person, group of persons or institutions. There will be provision for punishment for this.
Apart from these, “creating fake website for cheating or pecuniary gain”, “conducting fake examination, issuing fake admit cards or offer letters for cheating or pecuniary gain” and “manipulation of seating arrangement, allotment of dates and shifts of candidates to facilitate adoption of unfair means in examinations” are also among the offences punishable under the law.
what will be the penalty
According to the law, “Any person or persons resorting to unfair means and offences under this Act shall be punished with imprisonment of not less than three years but up to five years and a fine of up to Rs 10 lakh, however, this fine may extend to Rs 1 crore.” According to the previous rules, a person found cheating in the exam was liable to be imprisoned for three years and fined up to Rs 2000.
No strict action on students and candidates
However, both the Centre and UP laws do not impose direct penalties on students and candidates for minor cheating and copying, leaving their punishment to the discretion of examination officials. However, this flexibility has also been opposed. Critics argue that it may dilute the effectiveness of the law.
