New Delhi. Many times governments cut the salary of employees without any reason. Many times the salary is considered cut from the old time. The Supreme Court has expressed displeasure over such things. The apex court said on Thursday that any step of cutting the salary of a government employee and recovering it from him would be akin to punitive action, as it will have serious consequences.
The Supreme Court said, neither can the salary of any employee be reduced nor can the government take any such decision that the salary will be deducted from the previous month or last year. A bench of Justice Sandeep Mehta and Justice R. Mahadevan cancelled the order of Bihar government of October 2009 regarding deduction of salary of a retired employee. The state government had directed that first the salary should be deducted and if it is still not complete, then recovery should be made from them.
The retired employee had challenged the decision of Patna High Court. The High Court had accepted that his salary was cut while fixing the salary. This was according to the proposal issued by the government in February 1999. In which it was said that he was not entitled to get a higher salary. He was being given a higher salary in an unfair manner.
This person was appointed as a supply inspector in the Bihar government in 1966. After serving for 15 years, he got a promotion. But from April 1981, he was kept in the Junior Selection Grade. After 25 years of service, he was made SDO from March 10, 1991. After this, the state government issued a proposal in February 1999, in which the salary of the marketing officer and ADSO was revised from January 1996. That is, instead of increasing the salary, it was reduced.
The Supreme Court said, the person who retired from the post of ADSO on January 31, 2001, received a letter from the state government in April 2009. He was told that there was a mistake in fixing his salary, he was given more salary. Therefore, Rs 63,765 should be recovered from him. After this, the employee knocked the door of the High Court, but the High Court did not listen to him. Then he reached the Supreme Court.
