'This is unfortunate... cannot be allowed', High Court dismissed the petition


Mumbai. Cases of preventing government officials from working and threatening them are often seen and heard. Now the Bombay High Court has given a big decision in one such case. The High Court said that people’s trust in public servants cannot be allowed to diminish. While hearing the petition of the social worker, the High Court bench said that the Tehsildar is a respected officer in the district. He looks after revenue related matters. The High Court has also termed this entire incident as unfortunate.

The Bombay High Court refused to quash a case filed against a social worker on charges of extortion and defamation of a former tehsildar. The court said that it cannot let people lose faith in public servants. In its decision of July 1, a division bench of Justice AS Gadkari and Justice Neela Gokhale dismissed the petition filed by Solapur social activist Ajit Kulkarni. A copy of the High Court order in this case was made available on Saturday.

What is the matter?
According to the information, Prashant Bedase, former tehsildar of Mohol tehsil office, had lodged an FIR against Kulkarni in December 2022 on charges of using criminal force against a public servant, preventing him from performing his duty, extortion and defamation. The bench refused to quash the FIR and said that the threats given by Kulkarni to a public servant would amount to obstructing a public servant in performing his duties. Especially when the threats are associated with aggressive and dangerous work.

‘It is very unfortunate’
The High Court said in its order, ‘It is very unfortunate that a public servant has been intimidated and threatened by spreading derogatory things on social media to diminish his reputation.’ The court said that the Tehsildar is a respected government official in the district and he is expected to discharge important functions in revenue matters. The bench refused to quash the FIR and said, ‘Public trust in public servants cannot be allowed to be destroyed. Such cases should be taken seriously.’
