The state government has issued rules to legalize illegal colonies. Colonies that came into existence before December 31, 2016 will be developed. The Collector will start the process of developing civil infrastructure like roads, electricity, water, sewage system, parks etc. by the competent authorities. But before starting the process of development, FIR will be lodged against the developer of illegal colony under section 292C of Madhya Pradesh Municipal Act, section 339C of Municipal Act. Under this, now the way has been paved for the legalization of twenty one colonies of Khirkiya.
Such will be the development of illegal colonies
City Council CMO Rajendra Srivastava told that the layout will be prepared to provide basic facilities in the illegal colony. Property owners will be able to file objections on the said layout. Based on which the final layout will be prepared. On the basis of this layout, a plan for the development of the colony will be prepared. The development cost, time frame and development fee to be charged from the property holders will be decided.
Property holders will have to pay 50 percent development fee:
CMO Srivasta told that if 70 percent of the population in the illegal colony will be from the poor section, then the residents will have to deposit 20 percent development fee for development. The remaining 80 percent amount will be borne by the city council. But the middle or upper class residents will have to bear 50 percent development fee. Development fee can also be deposited in installments. Its rules will be decided by the competent authority. Property holders will also be able to take a loan to deposit the development fee. In case of non-deposit of development fee, recovery will be made as arrears of land revenue.
Constructions up to December 2016 will be included
Rule 15-A was added to the Madhya Pradesh Municipality (Registration of Colonizers, Terms and Conditions) Rules, 1998. In this, there was a provision to regularize unauthorized colonies developed till 31st June 1998 and the plots therein by charging fee for illegal construction. This deadline was first extended till 30 June 2002 and then till 31 December 2016.
This will be an advantage if the colony is legal
You will be able to take loan on the plot from the bank.
Other facilities including roads, electricity, water will be available through urban bodies.
– If the construction is more than the approved map up to 20 percent, then it will be validated by charging a settlement fee. More than that will be broken.
The income of the bodies will increase and disputes will also end.
Strict action will also be taken
Strict action will be taken against colonizers who build colonies without construction. Imprisonment of seven years and fine of ten lakh rupees. No action will be taken against the resident.
If the colonizer does not pay the amount of the fine, then recovery will be done by attaching the bank guarantee or property.
If illegal construction takes place, then the responsibility of the officials of the concerned urban body will also be fixed.
21 illegal colonies are recorded in the records of the city council in the urban area
There are 21 illegal colonies in the urban area in the records of the city council.
