The accused, identified as Akshay Jain and Prateek Jain, were taken into police custody on Friday.
Giving information about the matter, DCP (Economic Offenses Wing) M.I. Haider said that the complainants or the victims informed that the directors of Manju J Homes Limited induced them to book a flat in their proposed housing project ‘Red Apple Homes’ located in Ghaziabad, Uttar Pradesh.
So at the time of booking the flats in 2012, the victims were assured that the promised flats would be handed over to them within 3 years.
However, till date, the construction at the site is not completed and the builder company has stopped paying EMIs to the banks.
So far 51 complainants worth Rs 11 crore have approached the EOW, the official said.
He said that many of these complainants have alleged that though the loan was sanctioned on their applications, the loan amount was disbursed to the builder without their knowledge by forging signatures on several documents.
After preliminary investigation, investigation has been started by registering a case under sections 406, 409, 420, 467, 471 and 120B of the Indian Penal Code.
Investigation revealed that the land of the residential project is registered in the name of the accused builder company.
A notice was sent to the concerned District Collector, Sub-Registrar, SDM, Tehsildar, GDA, etc., under Section 102 of CrPC, requesting that the project land was used to cheat the investors and no further transfer or not constructed. Third party rights should be allowed on the same.
“The reply received from the Ghaziabad Development Authority revealed that the permission for the project was given in December 2015 and thereafter permission was to be obtained from the fire department, environment department and the municipal corporation,” the official said.
However, investigations by the complainants and the victims revealed that the builder company had started collecting money from investors from 2012 before the approval of the project.
Simultaneously the builder company erected the structures of the buildings and the construction was stopped in 2015.
Presently the project site was sealed for violating the condition of license of Ghaziabad Development Authority.
“The investigation also revealed that accused Prateek Jain and Akshay Jain along with other co-accused Vijayant Jain and Rajkumar Jain had started a company and a project named Red Apple Homage to dupe people,” the official said. had started.
According to the police, both the accused started evading investigation after joining the investigation in the initial stages.”
“Both the accused were arrested on March 25 and were taken on one-day police custody remand,” the DCP said.
