New Delhi. The Supreme Court on Friday once again gave a major directive in a case related to bail. The court said that when a court finds that anticipatory bail can be granted, it should be careful while imposing bail conditions. This should be taken special care of, especially in cases related to marital disputes. The Supreme Court said that it was saddened to see that despite several decisions condemning the cases of imposing tough conditions for anticipatory bail, such orders are being passed.
This comment of the Supreme Court has come in the decision, in which the condition imposed by the Patna High Court while granting interim anticipatory bail to a person in a case registered for crimes including crimes under the Dowry Prohibition Act-1961 was rejected. The bench of Justice CT Ravi Kumar and Justice PK Mishra of the Supreme Court emphasized the need to impose a condition to be followed while granting bail. The High Court, considering the wishes of both the parties, had directed them to file a joint affidavit before the lower court, stating that they have agreed to live together.

The Patna High Court had also said in its order that the petitioner would have to make a specific commitment to fulfill all the physical and financial needs of the complainant so that she can live a dignified life without interference from any member of her family. The Supreme Court said that the High Court’s order showed that the parties who were about to separate had reconsidered and expressed their desire to unite again by forgetting their differences.
The Supreme Court said that without the support of both the families, the relationship through marriage cannot develop but can be destroyed. The Supreme Court bench also said that imposing such conditions, as has been done in this case, can only be considered impossible and impractical.
