The issue of creamy layer reservation for Scheduled Castes (SC) and Scheduled Tribes (ST) is hot in the country. Law Minister Arjun Ram Meghwal has given his opinion on this issue. The Law Minister accused the opposition of creating confusion among the people regarding the Supreme Court’s comment regarding the ‘creamy layer’ between SC and ST. Law Minister Arjun Meghwal said that there is no provision of ‘creamy layer’ in the Constitution given by BR Ambedkar.

Ambedkar’s constitution will be followed

Meghwal said that the Bharatiya Janata Party and the NDA government will follow Ambedkar’s constitution. It will continue the reservation system provided in it for SC and ST. ‘Creamy layer’ refers to those people and families of SC and ST communities who fall in the high income group.

Supreme Court made just one comment on creamy layer

Meghwal said that the opposition knows that the Supreme Court has merely made a comment on the ‘creamy layer’, but it is still trying to create confusion among the people. Congress President Mallikarjun Kharge had said on Saturday that the idea of ​​denying reservation to SCs and STs on the basis of ‘creamy layer’ is reprehensible. He had also said that the government should have brought a law in Parliament to nullify the part of the Supreme Court’s recent decision that talks about this issue.

The Supreme Court did not give any decision

Meghwal said that the Supreme Court has said that if the states want, they can do sub-classification, but the Supreme Court has not given any decision on the creamy layer, it is merely a comment. Law Minister Meghwal reminded the opposition that there is a difference between an order and a comment.

What did the Supreme Court say on reservation for creamy layer?

Let us tell you that earlier this month, a seven-member Constitution Bench headed by Chief Justice of India DY Chandrachud had ruled by a majority of 6:1 that states can be allowed to make sub-classifications in Scheduled Castes (SC) and Scheduled Tribes (ST), to ensure that more backward castes are given reservation within these groups. Justice BR Gavai of the court wrote a separate but concurring judgment, in which the Supreme Court said the majority decision that the states have the right to sub-classify Scheduled Castes and Scheduled Tribes, to provide quotas within the reserved category for the upliftment of people from more disadvantaged castes.
