New Delhi. BJP has received a setback from the Supreme Court in the case of advertisement against TMC in West Bengal. The Supreme Court refused to interfere with the High Court’s decision in this matter, after which BJP withdrew the petition.
In fact, the West Bengal unit of the Bharatiya Janata Party had approached the Supreme Court against the order of the Calcutta High Court. The High Court had directed the BJP not to publish any advertisement violating the Model Code of Conduct during the Lok Sabha elections.
While hearing the BJP’s petition, the Supreme Court termed the advertisements against TMC as derogatory and said, ‘At first glance, the advertisements look derogatory. Elections are going on, why should we interfere in it. This will not be in the interest of the voters either.’ However, the Supreme Court has once again allowed the BJP to go to the High Court in this matter.

Earlier, a single judge bench of the Calcutta High Court had ordered the BJP not to publish such advertisements. On this, the BJP had approached the larger bench of the High Court, but it too had refused to interfere with the order of the single bench. The High Court, while rejecting the BJP’s petition, had said that ‘Lakshman Rekha’ should be followed and no political party should make any personal attack.

After this, BJP demanded an immediate hearing on the matter in the Supreme Court before the vacation bench of Justice Bela M Trivedi and Justice Pankaj Mithal. Advocate Saurabh Mishra, appearing on behalf of BJP, told the bench that the High Court has banned the party from issuing advertisements during the Lok Sabha elections till June 4. However, the Supreme Court refused to give them relief.
