Will the immense power of ED end? This question is being raised because the PMLA Act, with the help of which ED has taken action against many leaders, is going to be reviewed. The Supreme Court is going to reconsider its decision, in which ED was given a lot of powers under the PMLA Act. Let us tell you that under these laws, action has been taken against many prominent leaders including Delhi Chief Minister Arvind Kejriwal, Manish Sisodia, Hemant Soren, Lalu Prasad Yadav, Tejashwi Yadav.
A special bench of the Supreme Court will hear today the petitions filed against its 2022 decision in the Vijay Madanlal Choudhary case. In this decision, the Supreme Court had upheld various provisions of the Prevention of Money Laundering Act (PMLA) related to arrest, search, seizure, bail etc. A bench of Justices Suryakant, CT Ravikumar and Ujjwal Bhuyan will hear the case at 2 pm. The main petition has been filed by Congress MP Karti Chidambaram. He has challenged these provisions.
Application being listed for the first time
It is also worth noting that a separate three-member bench of the Supreme Court is hearing the petitions seeking reconsideration of the case of Vijay Madanlal Choudhary and handing it over to a larger bench. These petitions did not come before that bench then. After the notice was issued on August 25, 2022, these petitions are being listed for hearing for the first time on Wednesday.
ED has got these rights
A bench of Justice Sanjiv Khanna, Justice MM Sundresh and Justice Bela M Trivedi is hearing petitions challenging the validity of sections 50 and 63 of the PMLA Act. Under this section, the ED has the power to summon witnesses, record their statements and even file a case against them for giving wrong information. Under the 2002 law, the ED has so much power that it can raid anywhere. It can arrest anyone. It can confiscate anyone’s property. If these powers are curtailed, it will be a big change.
