In India, use of DJs is prohibited between 10 pm to 6 am under the Noise Pollution (Regulation and Control) Act, 2000. But there is no compulsion to do so. DJs in parties can use it from 10 pm to 12 am following some rules. In this, the DJ’s sound will have to be kept at the same level. So that no one faces any problem.
If anyone wants to play DJ after 10 pm. Then he will have to keep the sound less than 70 decibels. If it exceeds this and someone complains, action can be taken. Therefore, DJ can be played for 2 hours after midnight. But stay within a sound range.
The Indian Constitution has given some fundamental rights to the citizens of the country. Which also includes the right to live in an environment free from noise pollution. In which no one can make any mistake. If someone plays DJ or any other loudspeaker at night. In such a case, a case can be registered under sections 290 and 291 of IPC. Under this, there is a provision for both imprisonment and fine.
If someone in your area uses a loud DJ or loudspeaker. So you can directly approach the court against him. In which you can demand action from the Supreme Court under Article 32. You can also go to the High Court and file a case under Article 226.
