Lucknow News: The Janeshwar Mishra Trust located in the capital Lucknow has got a big relief from the High Court. The Lucknow bench of the High Court has banned the order to vacate the bungalow number 7 Vikramaditya Marg allotted to the trust. This order has been given by a bench of Justice Rajan Roy and Justice Manish Kumar. The court directed to maintain the status quo and clarified that at present, the action to vacate the bungalow will be stopped.
Bungalow allocation for 10 years
The bungalow was allocated to the Janeshwar Mishra Trust on 30 January 2017 at a monthly rent of Rs 72 thousand. The period was fixed at 5 years at the beginning of the allocation, which was later extended by the property department to 10 years under its regulations. The petition filed by the trust challenged the action to cancel or vacate the bungalow allocation as under the rules. This interim order of the High Court has given a big relief to the trust at the moment.
This amendment is not pre -influent
In 2021, the Uttar Pradesh government had made a provision for not more than 5 years by amending rules. On this basis, the allocation of the bungalow ended on 2 January 2022. But the trust argues that this amendment cannot be considered pre -influent. The government has asked the government that when the allotment period ended in January 2022, why the bungalow fare was taken even after that? The court has given the government three weeks to respond.
