A Pune court on Saturday rejected the application of Rahul Gandhi, seeking information about the mother -in -law of Vinayak Damodar Savarkar, Satyaki Savarkar.
In the case of the alleged objectionable remarks made by the Congress leader on Savarkar, Satyaki has filed a defamation complaint and Rahul had requested to provide information about his mother’s family by applying in the court.
Judicial Magistrate (First Class) Amol Shinde rejected the application, saying that the matter is related to the alleged derogatory speech given by Rahul Gandhi in London, not Satyaki Savarkar’s mother from the maternal uncle of late Himani Ashok Savarkar.
Himani Savarkar was the daughter of Gopal Vinayak Godse, the younger brother of Nathuram Godse, the killer of Mahatma Gandhi.
Rahul Gandhi had argued through his lawyer Milind Pawar that the complainant had given details of his father’s family while registering the complaint, but has not given information about his mother’s maternal uncle. The defense argued that this information was important for hearing.
The court said in its order, “This case is not related to or dispute related to the lineage of late Himani Ashok Savarkar. Therefore, this court does not see any quality in the application of the accused. There is no need to send the case for further investigation. ”
Meanwhile, the court also dismissed the petition of Satyaki Savarkar, who requested Gandhi’s bail, said that the Aadhaar given is not sufficient for such action.
Savarkar alleged in his petition that the date of January 10, 2025 was fixed to respond to the accused in the case, but the accused is not filing his reply on some excuse and adopting a strategy to delay.
The judge said that Gandhi has been granted bail with permanent exemption from personal presence and there is no evidence that he is deliberately delaying the proceedings.
The order said, “It was not found that the accused was pulling the case long. The Aadhaar mentioned in the application is not appropriate to take strict action against the accused. Therefore, the application is eligible to be rejected. ”
Satyaki Savarkar has filed a defamation complaint against Gandhi’s speech in London in March 2023. The former Congress president allegedly claimed in the said speech that VD Savarkar wrote in a book that he and a group of friends had once beat up a Muslim person and Savarkar was happy.
The complainant argued that Savarkar never made a claim and called Gandhi’s comment “fictional, false and malicious”.
