Hearing against Waqf Act in Supreme Court today, CGI bench will listen to argument

New Delhi, 16 April (IANS). The apex court will hear the Waqf Amendment Act today. The CGI -led bench will hear the arguments of the petitions filed against the law.

According to the suit list released on the website of the apex court, the bench -led bench (which includes Justice Sanjay Kumar and Justice KV Vishwanath) will hear the case from 2 pm on 16 April.

Several petitions challenging the constitutional validity of the recently made amendments in the Waqf Act, 1995 have been filed in the apex court.

In response to the petitions seeking to ban the implementation of the Waqf (Amendment) Act, 2025, the Central Government has filed a cavity in the Supreme Court.

Caviet is a notice that is presented by the party’s party to the court, who wants to listen to the case of a stay order on the petition of the opposing party. Also, many BJP ruled states including Haryana, Maharashtra, Madhya Pradesh, Rajasthan, Chhattisgarh, Assam and Uttarakhand have approached the Supreme Court to defend the Waqf (Amendment) Act, 2025.

After the bill passed in the first week of April by Parliament, the Congress party announced that it would challenge in front of this Waqf Bill (now this Waqf Law after the President’s approval). At that time, the Congress had said that this is an attack on the basic structure of the Constitution to polarize and divide the country on the basis of religion.

In response, the central government had said that after the passing of this bill, crores of poor Muslims will benefit and no Muslim will harm it.

Minority Affairs Minister Kiren Rijiju claimed that this law would not interfere in Waqf’s properties. He said that the Modi government is working with the vision of ‘Sabka Saath, Sabka Vikas’.

Congress MP and party whip Mohammad Javed in the Lok Sabha has argued in his petition filed in the apex court that this law is Article 14 (Right to Equality) Article 25 (Right to Freedom to Follow and Freedom of Religion), Article 26 (Right to Freedom to Managing Religious Sects) Article 29 (Right to Freedom) Article 29 (Right to Minorities) and Article 300-A.

Another petition filed on behalf of All India Majlis-e-Ittehadul Muslimeen (AIMIM) Chief Asaduddin Owaisi stated that the amendment laws have a clear violation of Articles 14, 15, 21, 25, 26, 29, 30, 300-A of the Indian Constitution and are clearly arbitrary.

Association for Protection of Civil Rights, AAP Leader Amanatullah Khan, Maulana Arshad Madni of Jamiat Ulema-e-Hind, All India Muslim Personal Law Board (AIMPLB), Social Democratic Party of India (SDPI), Indian Union Muslim League, Tayyab Khan Salmani and Anjum Kadri, many others including Vakf (Amendment) Acts 2025 Petitions challenging validity have been filed.

The concept of ‘Waqf’ inherent in Islamic laws and traditions refers to donations made by a Muslim for charitable or religious purposes, such as mosques, schools, hospitals or other public institutions.
