Jamiat Ulema-e-Hind challenged the validity of the Waqf (Amendment) Act in the apex court

The major Muslim organization Jamiat Ulema-e-Hind (AM) has filed a petition in the Supreme Court challenging the constitutional validity of the Waqf (Amendment) Act 2025, claiming that it is a ‘dangerous conspiracy’ to take away the religious freedom of Muslims.

President Draupadi Murmu on Saturday approved the Waqf (Amendment) Bill, 2025, which was previously passed after heated debate in both houses of Parliament.

Several petitions have been filed in the apex court challenging the validity of this bill. These include a petition filed through Zulfikar Ali PS, advocate of the entire Kerala Jamiat-ul Ulema, a religious organization of Sunni Muslim scholars of Kerala.

In its petition, Jamiat Ulema-e-Hind (AM) has said that this law is ‘a direct attack on the constitution of the country, which not only gives equal rights to its citizens, but also gives them complete religious freedom’.

Jamiat said in a press release, ‘This bill is a dangerous conspiracy to take away the religious freedom of Muslims. Therefore, we have challenged the Waqf (Amendment) Act, 2025 in the Supreme Court and the state units of Jamiat Ulema-e-Hind will also challenge the constitutional validity of this law in the High Courts of their respective states. “

It said, “Jamiat Ulema-e-Hind (AM) President Maulana Arshad Madni has not only challenged various provisions of the Waqf (Amendment) Act, but has also filed an interim petition in the court to prevent this law from being effective.”

At the same time, ‘All Kerala Jamiat-ul Ulema’ has said in its petition that these amendments will distort the religious character of Waqf and will also cause irreparable damage to the democratic process in the administration of Waqf and Waqf boards.

The petition stated, “Hence our argument is that the Act of 2025 is a clear intervention in the rights of the religious sect to manage its matters on the subject of religion. This right is preserved under Article 26 of the Constitution of India. ”

Many people, including Congress MP Mohammad Javed, AIMIM President Asaduddin Owaisi and AAP MLA Amanatullah Khan, had filed a petition in the apex court challenging the validity of the bill.

Apart from these, an NGO -‘Association for the Protection of Civil Rights’ -has also filed a petition in the apex court challenging the constitutional validity of the Waqf (Amendment) Bill, 2025.
