Ranchi/New Delhi, January 17 (IANS). Rejecting the order of Jharkhand High Court, the Supreme Court has given permission to transfer gang war accused Vikas Tiwari, lodged in Jaiprakash Narayan Central Jail, Hazaribagh, to Dumka Central Jail.
This order was given by Justice JB while hearing the appeal petition of Jharkhand Government. Pardiwala and Justice R. Mahadevan’s bench gave this on Friday. The court also directed the Jharkhand government to prepare a new jail manual as per the provisions of the Model Jail Manual of 2016 and ensure its strict compliance in jail administration.
The court said that the state government should also ensure that the fundamental rights of the prisoner being transferred are protected.
Jharkhand government had said in its petition that several criminal cases were registered against Vikas Tiwari, lodged in Jaiprakash Narayan Central Jail located in Hazaribagh. He has been involved in gang war in the past and in view of the fear of gang war and danger to his life due to his stay in this jail, IG Prison had ordered to transfer him to Dumka Central Jail.
This order of IG Prison was challenged by Vikas Tiwari in Jharkhand High Court. After hearing his petition, the High Court in its decision on August 21, 2023 had canceled this order of the jail administration. Jharkhand High Court had said in its order that contrary to the claims of the state government, Hazaribagh Jail Superintendent in his letters has described the conduct of prisoner Vikas Tiwari, who has been lodged for seven and a half years, as satisfactory.
The state government had challenged this order of Jharkhand High Court in the Supreme Court, which was approved on Friday.
