Supreme Court will hear the contempt petition filed in Sambhal demolition case after a week.

The Supreme Court on Friday said it will hear after a week a plea seeking initiation of contempt proceedings against the authorities for alleged violation of its order regarding demolition of properties in Sambhal. The petition was filed by Justice B. R. Gavai and came up for hearing before the bench of Justice Augustine George Masih.

The lawyer appearing for petitioner Mohammad Gayur sought adjournment of the hearing for some time and said that the arguing lawyer was in personal trouble.

He requested the bench to list the matter for hearing after a week. The bench said that the petition should be presented for hearing after a week.

In his petition filed through advocate Chand Qureshi, the petitioner has alleged violation of the November 13 decision of the apex court. The judgment laid down all India guidelines stating that no property should be demolished without a show cause notice and 15 days’ time should be given to the affected people to respond.

The petition claims that the authorities in Sambhal, Uttar Pradesh, bulldozed a portion of his property on January 10-11 without giving any prior notice or opportunity to the petitioner or his family members.

The petition states, “The petitioner has stated that he and his family members had all the necessary documents of the property, approved maps and other related documents, but the contempt officers came to the premises of the petitioner’s property and demolished the said property. Started doing.”

In its judgment of November 2024, the Supreme Court had passed several directions making it clear that these directions will not apply if there is any unauthorized structure in a public place like a road, street, footpath, adjacent to a railway line or near any river or water bodies and Will not be applicable even in cases where the court has ordered demolition.
