Former councilor and accused of February 2020, Tahir Hussain, accused of Delhi communal riots, on Tuesday requested the Supreme Court to allow him to campaign while detaining for the upcoming Delhi assembly elections.
Senior Advocate Siddharth Aggarwal, appearing on behalf of Tahir Hussain, told the bench of Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta that there are only four-five days left for the election campaign, so they are left to contact voters in police custody. Will be allowed.
Advocate Siddharth Aggarwal said, “There were riots in Delhi where my house is being told. I am contesting from Mustafabad seat, and even for the purpose of living, I am saying that I will not go home and stay in a hotel and provide details of it. ,
Additional Solicitor General SV Raju opposed Tahir’s request, saying that his role is serious. He said that if relief is given, everyone will file nomination from jail.
The court asked Raju to ask for instructions about what kind of expenses and what kind of security would be needed. The bench also asked Aggarwal to tell what Hussain would promise. The order in this case will be pronounced at 2 pm.
Hussein did not get interim bail after a divided decision was given by a bench of two judges of the Supreme Court on 22 January.
The Delhi High Court on 14 January was awarded Hussain to the ‘All India Majlis-e-Ittehadul Muslimeen’ (AIMIM) for de-custody parole for filing nomination papers from Mustafabad constituency.
There were riots in North-East Delhi on February 24, 2020, killing 53 people and many were injured.
Hussain is accused in the case related to the death of Ankit Sharma, an employee of the intelligence bureau.
