In Chhattisgarh, a minor girl who was a victim of rape approached the court for abortion after she became pregnant. But the highest court of Chhattisgarh has refused to order abortion. The victim is a resident of Rajnandgaon district. High Court Justice Parth Pratim heard the case. He has taken this decision on the basis of the advice of a 9-member medical team.
When a minor rape victim living in Rajnandgaon district became pregnant, her parents filed a petition in the High Court to allow abortion. But the High Court refused it. The court has taken this decision keeping in mind the health of the minor, because experts say that abortion can prove dangerous for the victim.
Justice Parth Pratim Sahu has heard this case. He had asked to give the victim’s examination report to a 9-member team of specialist doctors. The team found in its examination that a 20-week pregnancy can be terminated. However, in special circumstances, a 24-week pregnancy can be terminated to save the victim’s life. But in this case, the victim has been pregnant for more than 24 weeks. In such a situation, terminating the pregnancy can prove fatal for her health.
The medical report found that the pregnancy age of the petitioner was about 32 weeks. Due to this, the doctors have given the opinion that terminating the pregnancy would be more risky than giving birth naturally to the victim. Therefore, based on the opinion of the experts, the High Court rejected her petition.
The court has directed the state government to make all necessary arrangements and bear all expenses for the birth of the child of the minor rape victim. The court said that if the minor and her parents wish to give the child for adoption after delivery, the state government will take necessary steps as per the applicable provisions of the law.
