The case of the disputed five-storey mosque of Sanjauli has reached the Himachal Pradesh High Court. In the petition filed by the local residents of Sanjauli, High Court Judge Sandeep Sharma has ordered the Municipal Corporation Commissioner to give the decision within eight weeks. Advocate General Anoop Ratan, appearing on behalf of the state government, told the High Court that the Municipal Corporation Commissioner has given orders to remove the illegal construction of the mosque within two months. The government is taking action in the matter. After hearing both the sides, the High Court asked the Commissioner to settle the matter on time and make all the stakeholders a party.
In fact, in the petition filed in the High Court on behalf of the local citizens of Sanjauli, it has been requested that the High Court should direct the Municipal Corporation Commissioner to time-bound the disposal of this illegal construction case which has been going on since 2010. Hearing this on Monday, the High Court passed the above orders.
In 2010, local citizens had lodged a complaint with the Municipal Corporation that illegal construction was taking place in Sanjauli Masjid without permission and without getting the map passed. During the 46th hearing of this case in the Municipal Corporation Court on October 5, the upper three floors of the mosque were declared illegal and orders were given to demolish it. Acting on this, the Mosque Committee started the work of demolishing the illegal construction today itself. The next hearing of the case is to be held on December 21 in the court of Municipal Corporation Commissioner.
Case pending for 15 years
Advocate Jagat Paul, on behalf of the local residents, said that the High Court, accepting their petition, has issued orders to the Municipal Corporation Commissioner to conclude the entire proceedings of this case within eight weeks. This matter is pending for about fifteen years.
At the same time, advocate Payal said that he has presented many facts before the Himachal Pradesh High Court. The High Court has been told that the Municipal Corporation’s papers show that the entire mosque has been constructed illegally. Local people had also lodged a complaint in this regard in 2010. The then JE had come to the spot on May 5, 2010 and had also written in his report that illegal construction had been done here.
Let us tell you that in the year 2010, a complaint was filed in the Municipal Corporation on behalf of the local residents, in which it was said that illegal construction was being done in the mosque in Sanjauli. It was said in the complaint that the construction is being done without the permission of the concerned authority and without getting the map approved, which should be stopped, but no action has been taken in the matter and the matter is pending in the Municipal Corporation Court for 14 years, on which today the High Court has now given eight weeks’ stay. Orders have been given for disposal within.
