Raj ballabh yadav rape case: A big and shocking news related to the politics of Bihar has come out. Patna High Court has acquitted former RJD MLA Rajaballabh Yadav of Nawada in the case of rape from a minor. In 2018, the lower court sentenced Rajaballabh to life imprisonment in the case, but the High Court in its judgment overturned the lower court order. This decision has once again brought a new twist in this popular case.
Why did the High Court acquit?
A division bench of Justice Mohit Kumar Shah and Justice Harish Kumar, while hearing the case, noticed several important points. The court said in its judgment that the prosecution failed to prove that the victim was forcibly raped.
medical report: The High Court, citing a medical examination, said that the doctors found that the victim was accustomed to have sex and there was no evidence to forcefully.
Age dispute: The prosecution could not even prove that the victim was under 18 years of age, which was an important aspect of the case.
FSL Report: The court said that the victim’s clothes were sent to the FSL (Forensic) lab for investigation, but her report was not brought on record. On this basis, the court gave ‘benefit of doubt’ to all the accused including Rajaballabh Yadav.
What was the whole matter?
This case is of 2016. A girl had lodged a complaint with the women’s police station of Biharsharif. He had alleged that her neighbor Sulekha Devi took her somewhere on the pretext of a birthday party, where former MLA Rajaballabh Yadav raped her. In this case, Rajaballabh Yadav was sentenced to life imprisonment from the lower court in 2018. The High Court has ordered Rajaballabh Yadav as well as Sulekha Devi, Radha Devi, Sandeep Suman, Tussi Devi and Chhoti Devi to be acquitted from the jail, while acquitting all the allegations. This decision has once again intensified the politics of Nawada and Bihar.
