Muslim religious leader Mufti Mohammad Salman Azhari has got a big relief from the Supreme Court. The court has canceled his detention under the Gujarat Prevention of Anti-Social Activities Act (PASA), 1985. A bench of Justices Vikram Nath and Prasanna B Varale said, ‘After perusing the material on record, we feel that the order of detention cannot be sustained as there is nothing to suggest that the speeches made by the appellant Public order has been disrupted in any way.
On July 29, 2024, the Gujarat High Court had upheld Azhari’s detention order of February 16, 2024, issued by the Junagadh District Magistrate, saying that ‘the material on record in the present case is sufficient to hold that the detained person The alleged prejudicial activities have either adversely affected or are likely to adversely affect the maintenance of public order within the meaning of Section 4(3) of the Act.’
The Maulvi approached the Supreme Court against this order. Senior lawyer Huzefa A Ahmadi, appearing for Azhari, said the material relied upon by the detaining officer was insufficient to conclude that his activities were prejudicial to the maintenance of public order.
Additional Solicitor General SV Raju and lawyer Swati Ghildiyal, appearing in the court on behalf of Gujarat, sought justification of the detention. Accepting the appeal, the Supreme Court rejected the High Court order on detention. The court directed that Azhari ‘be released immediately’. The custodial officer considered the two FIRs lodged against the petitioner and the material produced in respect of the said offenses and came to the conclusion that the activities of the petitioner were prejudicial.
