Madhya Pradesh High Court acquitted two women in the case of murder of a man in 2008. However, one of these two women, Suraj Bai, had to spend 14 years in jail. A division bench comprising Justice GS Ahluwalia and Justice Vishal Mishra directed the trial court to initiate action against the prosecution witnesses for perjury and giving evidence.

Suraj Bai was accused of killing her brother-in-law with the help of her relative Bhuri Bai and trying to make the incident look like suicide by hanging the body from a tree. The court gave him relief last week. On October 16, the court, while accepting his appeal against the conviction, in its order directed the immediate release of Suraj Bai from jail. Although Bhuri Bai was already out on bail.

The High Court said that the lower court treated the case very carelessly. The trial court should understand that it is deciding about someone’s life and liberty. No one should be punished without sound principles of law. The division bench said that blindly accepting the statements of prosecution witnesses is not the proper way to examine the evidence.

The court of Justice GS Ahluwalia and Justice Vishal Mishra said- In this case a woman has been in jail for 14 years. Not only this, the other one has been forced to stay in jail with her minor children. The witnesses deliberately gave false statements. The police did not even investigate the case properly. This gave the prosecution witnesses an opportunity to implicate the petitioner women.
