The Supreme Court today refused to hear a petition related to the Gujarat Authority’s bulldozer action case. The court also instructed the petitioner regarding the case. The court refused to hear a petition seeking contempt action against Gujarat officials for allegedly violating its instructions to demolish the house from bulldozer action. The case was heard by a bench of Justice BR Gavai and Justice Augustine George Christ.
Asked to go to the High Court
The bench refused to hear the case and also instructed the petitioner to turn to the concerned High Court along with the complaint. The Supreme Court was hearing a petition seeking contempt action against state officials to allegedly disregard the instructions of its decision on 13 November 2024.
What was said in the petition
The petitioner’s counsel told the court in his argument that the houses dropped by the officials were built on the petitioner’s private land. After this, the Supreme Court told the petitioner’s counsel that why do you not go to the High Court? It will be difficult for us to monitor every matter from here. We are not keen to hear the current petition. In the judgment, guidelines were fixed at the national level. On behalf of the court, the reasons were banned from the demolition of various structures without giving a show cause notice and 15 days’ deferment to respond to the victim side.
The petition filed by the petitioner’s counsel Parasnath Singh said that 3 houses and a hut of an accused were demolished by Ahmedabad Municipal Corporation officials without following the appropriate process and violating the guidelines issued by the Supreme Court.
Violation of Supreme Court directions
In the petition, the petitioner said that the officials did not give any information in advance regarding the landing of the houses. The petitioner of the Minority Coordination Committee in Gujarat claimed that the officials have violated the Supreme Court’s directions by landing three houses in Ahmedabad in December last year.
Explain that the Supreme Court had said during a decision of November 2024 that no sabotage should be done within the stipulated time by the local municipal laws within the stipulated time or within 15 days from the date of the notice and without issuing a show cause notice.
