Patna High Court has summoned the SP of East Champaran as the trial of a 35-year-old murder case could not start due to non-availability of police records. A single bench of Justice Arvind Singh Chandel gave this order while hearing a criminal writ petition filed by 11 applicants including Birendra Mahato. The court has ordered the SP of East Champaran to appear in the court. Senior advocate Krishna Prasad Singh, on behalf of the applicants, told the court that an FIR was registered against all these 11 applicants in 1988 at Darpa police station in East Champaran for assault and murder.
A year later, in 1989, all these accused were granted bail. They said that they have been attending court for the last 35 years in compliance with the bail conditions. The surprising thing is that the prosecution is still unable to start the trial because the police record of this case is not available.
Due to which the Chief Judicial Magistrate is not sending the case to the Sessions Court for trial. The court accepted the arguments presented on his behalf and summoned the SP. The next hearing on the case will be on October 3.
