Ahmedabad: The Gujarat High Court on Monday allowed the 33 -week pregnant 13 -year -old rape victim to abortion. His petition was dismissed by the Special Poxo court about a week ago. Justice N Desai said that medical opinions indicate that the closing of pregnancy is possible, although the process has a high risk of complexity as the girl suffers from anemia.
What is the whole matter?
The victim, a resident of Rajkot, was raped by her neighbor repeatedly when her mother and stepfather were out for work. An FIR was registered on May 3, 2025 in the case. Protection of children from sexual offenses (POCSO) Act affairs was rejected by his petition to allow abortion. Abortion is generally prohibited after 20 weeks of pregnancy under the Medical Closing Act of pregnancy, but the court may allow it in some cases such as abnormalities in the fetus, the health of the pregnant mother, or he is a victim of sexual harassment.
The High Court said that it has considered the fact that the victim is only 13 years old and has a long life in front of her. The court said that since MTP (medical completion of pregnancy) is possible, it should be done only after obtaining written consent from his parents, in which it should be reported that they understand the risk.
Order given to the doctors’ panel
The court directed the Medical Officer and Medical Superintendent in charge of PDU Hospital of Rajkot to complete the procedure by ensuring that all possible care should be taken and probably necessary medical facilities like blood supply should be provided on Monday itself. Also, a panel of doctors told the court that a specialist doctor will also have to be present at the time of abortion.
