The petition challenging the election of BJP’s Rajya Sabha MP Harsh Mahajan from Himachal Pradesh was heard in the Himachal Pradesh High Court on Monday. After hearing the arguments of both the parties, the High Court has given a shock to Harsh Mahajan in this case. The court has rejected the appeal of the BJP MP seeking dismissal of Abhishek Manu Singhvi’s petition.
The High Court has refused to dismiss the petition filed by Abhishek Manu Singhvi questioning the election process. Also, orders have been issued to Harsh Mahajan, who has been made a respondent, to respond within two weeks.
Harsh Mahajan’s lawyer in Himachal Pradesh High Court, Vikrant Thakur, said that he had filed an appeal and requested the court that Abhishek Manu Singhvi’s petition is not mandatorily maintainable, but the court has not accepted the appeal and has asked to file a reply within two weeks on the petition filed by Abhishek Manu Singhvi.
Let us tell you that Rajya Sabha elections were held in Himachal Pradesh on 27th February. Despite Congress having majority, BJP candidate had won. In Himachal Pradesh, Congress has 40 MLAs and BJP has 25, while three independent MLAs supported the government in the 68-seat assembly. But in the Rajya Sabha elections, six Congress and three independent MLAs voted against the Congress candidate and both the candidates got equal 34-34 votes in the election. After this, the Election Commission adopted the slip process in which BJP candidate Harsh Mahajan won. Abhishek Manu Singhvi has challenged this slip system in the High Court. Questioning the result obtained from the slip after the tie in voting, Singhvi appealed to the High Court to cancel the election. Abhishek Manu Singhvi says that the concept of declaring the candidate whose slip comes out as the loser is not legally justified. Now the hearing in this case will be held in the High Court after two weeks.
