The Supreme Court Collegium has recommended extension of tenure of 9 judges in the Calcutta High Court.
New Delhi: The Supreme Court Collegium headed by Chief Justice of India DY Chandrachud has recommended extending the tenure of 9 additional judges of the Calcutta High Court by one year. In April this year, the Calcutta High Court Collegium unanimously recommended the appointment of Justice Biswarup Chowdhury, Justice Partha Sarathi Sen, Justice Prasenjit Biswas, Justice Uday Kumar, Justice Ajay Kumar Gupta, Justice Supratim Bhattacharya, Justice Partha Sarathi Chatterjee, Justice Apurba Sinha Ray and Justice Mohammad Shabbar Rashidi as permanent judges.
The Supreme Court had formed a committee
The Supreme Court Collegium said that it had consulted other Supreme Court judges familiar with the cases of the Calcutta High Court to ascertain their suitability. It also said that a committee of 2 Supreme Court judges constituted by the Chief Justice evaluated the decisions of these additional judges. The Supreme Court Collegium, after examining and evaluating the documents placed on record and considering all aspects of the case, found that these additional judges are entitled to a new term of one year starting from August 31, 2024.
CM and Governor have not commented
According to a statement released on the Supreme Court website, “The Chief Minister of West Bengal and the Governor of the state have not yet commented on this recommendation. The Department of Justice has forwarded the above recommendation citing Para 14 of the Memorandum of Procedure, which states that if the comments of the constitutional authorities in the state are not received within the prescribed time limit, the Law and Justice Minister should assume that the Governor and the Chief Minister have nothing to add to the proposal and should proceed accordingly.
