The US Supreme Court has dismissed the petition of Tawwur Rana, accused in the 26/11 Mumbai attack, to ban India’s extradition. Justice Elena Kagan rejected Rana’s application on Thursday (local time), requesting India to stop its extradition.
Tahwwur Rana had approached the Supreme Court of the United States to ban India on his extradition. In his application, Rana argued that he would not be able to survive for enough time to prosecute in India for various reasons.
Rana said via the appeal, “If there is no adjournment, there will be no review, and the US courts will lose their jurisdiction, and the petitioner will die soon.”
The accused of the 26/11 terror attacks claimed that if he was extradited to India, it is very likely that he would be tortured, as he is a Muslim of Pakistani origin.
He said that his condition as his Muslim religion, Pakistani origin, former Pakistani army members, alleged allegations with the 2008 Mumbai attacks, and his serious health status, is more likely to be tortured, and he can also die early due to this torture.
He cited the Human Rights Watch 2023 World Report, which by the government to discriminate and stigmatize religious minorities, especially Muslims, especially Muslims. Rana further argued that the government in India is becoming autocratic, and there are enough grounds to believe that if he surrenders to Indian authorities, he can face torture.
Apart from these concerns, Rana also highlighted his deteriorating health. Earlier in February, US President Donald Trump announced the extradition of Tehwavur Rana to India and said that he would have to face justice.
He made this announcement at a joint press conference with Prime Minister Narendra Modi after a bilateral meeting. Tahwwur Rana is an associate of Pakistani-American terrorist David Coleman Headley, who was one of the main conspirators of the 26 November attacks in Mumbai.
Rana, a businessman, doctor and immigration entrepreneur of Pakistani origin, is accused of allegedly having alleged relations with Lashkar-e-Taiba (LET) and Pakistan’s Inter-Services Intelligence (ISI). Rana’s alleged role in carrying out the attacks has been a matter of controversy between India and America for many years.
