The High Court has said that it is mandatory for students pursuing MBBS from abroad to have at least 50 per cent marks in Science in class 12th to appear in the screening test to register themselves as doctors in India. Justice V. Kameswara Rao has given this decision by dismissing the petition of a student who completed MBBS from Medical College, Nepal.
They have upheld the decision of the National Medical Commission (NMC) that barred the petitioner from appearing in the screening test to be registered as a doctor for not having 50 per cent marks in Biology, Chemistry and Physics in class 12th. was stopped. The court upheld the decision of the NMC by citing the provision of the Indian Medical Council Act 1956.
The court said that a student should have 50 per cent marks in Physics, Chemistry and Biology in class 12 to be able to apply for MBBS courses. Justice Rao said the same minimum marks criteria should be followed in case of foreign MBBS degree holders for registration in India.

Apoorva Shankar, originally from Bihar, said in the petition that he got 50 per cent marks in Intermediate (12th class) from Bihar Board with Physics, Biology, Chemistry and English combined. The student has only 47.83 percent marks in all three science subjects. Shankar enrolled in the MBBS course at BP Koirala Health and Science (Medical College) in Nepal. After completion of MBBS and one year internship, the petitioner had applied for appearing in the screening test last year to be registered as a doctor in India. This test is conducted by the National Board of Examinations. NMC rejected the application sent by the petitioner to appear in the examination for not having 50 per cent marks in science subjects.
