New Delhi. Supreme Court Chief Justice DY Chandrachud has said an important thing. Speaking candidly in a program of Indian Express on Monday, he said that after the advent of social media, such pressure groups are especially visible, which try to put pressure on the court by using electronic media. Chief Justice Chandrachud said that these pressure groups create such an environment that if the decision comes according to them, then it will be considered that the courts are working independently. Giving an example, he said that when the Supreme Court decides against electoral bonds, it is said that the court is independent, but if the decision goes in favor of the government, then the judiciary is no longer independent. Chief Justice Chandrachud said that this is not the definition of my freedom.
Chief Justice DY Chandrachud said that the independence of the court does not mean that it always gives decisions against the government. Chandrachud, who is retiring from the post of Chief Justice of the Supreme Court on November 10, said that he has objection to this. He said that a judge’s conscience is guided by the law and the Constitution. He also mentioned the issue of PM Narendra Modi visiting the Chief Justice’s residence on the occasion of Ganpati Puja. Chandrachud said that he does not find anything wrong in this. Supreme Court Chief Justice Chandrachud said that meetings take place between the judiciary and the executive and also at the social level. He said that we also meet at programs held at Rashtrapati Bhavan and on occasions like Republic Day. In this conversation, those matters on which the court takes decisions are not discussed.
Chief Justice Chandrachud said that division of powers in a democracy does not mean that the judiciary should not make policies because it is the prerogative of the executive. He said that it is the job of the government to prepare the policy. The executive can never interfere in judicial matters. Chandrachud said that as long as there is a clear difference, there is nothing wrong in the meeting and conversation between the judiciary and the executive. The Chief Justice of the Supreme Court had earlier also said that it was not wrong for Modi to go to his residence and take part in Ganpati puja. Politics was heated on this matter and many people including opposition leaders had pointed fingers towards Chandrachud by accusing him of compromising the independence of the judiciary.
