New Delhi. The new Waqf law has been implemented in the entire country. President Draupadi Murmu has signed the Pass Waqf Amendment Bill from Parliament. The central government has also issued its notification. With this, the war on the Waqf law is going to start in the Supreme Court. 4 including AIMIM MP Asaduddin Owaisi has filed a petition against the Pass Waqf Amendment Bill from Parliament. The Lok Sabha passed late night of April 2 and the Rajya Sabha passed the night of 3 April after a long discussion with the Waqf Amendment Bill. Opposition parties opposed it in both houses.
Under the provisions of the new Waqf law, the Waqf Board will no longer be able to claim any property itself. Disputes on any property can also be challenged in court. Sections of the Limitation Act will also apply to Waqf properties. Apart from this, only the one who follows Islam for 5 years will be able to donate property to Waqf. Under the new Waqf law, the land of tribals will not be able to work. Also, it has been made necessary to record every Waqf property in the revenue records. Now the DM of the district will be able to survey Waqf properties. The DM will decide whether the related property is Waqf or not on the basis of revenue records.
Under the new Waqf law, no property will be considered as Waqf on the basis of only use. That is, the Waqf by user has been removed in the new Waqf law. Ancient monuments under government property and ASI will also not be Waqf. The notification of the new Waqf law has been issued on 5 April. Earlier, all the Waqf Property Waqf Boards (except disputed) will not apply the provisions of new laws to them. Now everyone is eyeing whether the Supreme Court approves the new Waqf law or not. Because those who filed the petition against it have said that the new Waqf law violates unconstitutional and right to obey religion.
